These Terms of Service ("Terms") govern your use of growwithrooted.com (the "Site"), which is operated by Paleo Holdings, LLC ("Rooted," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.
These Terms apply only to the Site. The Rooted iOS application, when released, will have its own separate Terms of Service reflecting the broader scope of the application. These Terms will be updated, or separate terms published, at that time.
The Site is an informational landing page for Rooted, a forthcoming iOS application currently in development. The Site allows you to subscribe to a waitlist to be notified when Rooted launches. The Site does not currently provide any other service.
References on the Site to future features, capabilities, or release dates of the Rooted application are descriptions of our current development plans. They are not guarantees, and we may change them without notice.
You agree that, in using the Site, you will:
If you submit your email address through the Site, you consent to receive emails from us about Rooted. You may unsubscribe at any time, and we may discontinue sending emails at any time without notice.
All content on the Site, including the Rooted name, logo, written copy, visual design, and code, is owned by Paleo Holdings, LLC or its licensors and is protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our prior written permission, except for personal, non-commercial use.
Rooted may invite you to contribute a photo you have taken, for example by offering your plant photo to be used as a field guide image. Contributing is always optional. When you choose to contribute a photo, you grant Paleo Holdings, LLC a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, display, adapt, crop, and distribute that photo in connection with Rooted's plant guides, website, app, and related marketing. You retain ownership of your photo, and this license continues for photos we have already published unless and until they are removed.
By contributing a photo, you represent that you took it or otherwise have the right to share it and to grant this license, that it does not infringe the intellectual property, privacy, or other rights of any person, and that it does not depict people who have not consented to appear. We review contributions before use, and we are not obligated to use any submission. You may ask us to remove a contributed photo from future use at any time by contacting privacy@growwithrooted.com.
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted or error-free, and we do not warrant that the Rooted application will launch on any particular date or include any particular feature.
To the fullest extent permitted by law, in no event will Paleo Holdings, LLC or its officers, members, or agents be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to the Site will not exceed one hundred dollars ($100.00).
You agree to indemnify and hold harmless Paleo Holdings, LLC and its officers, members, and agents from any claim arising out of your breach of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in McLennan County, Texas, and you consent to the jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms at any time. Material changes will be reflected by updating the effective date at the top of this page. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
